These Terms and Conditions (“Terms”) govern your access to and use of casacristal.com (the “Site”), operated by Casa Cristal Nursery, Inc. (“Casa Cristal,” “we,” “us,” or “our”).
Please read these Terms carefully. By accessing or using the Site, you agree to be bound by them. If you do not agree, do not use the Site.
You may use the Site for lawful purposes only, and only to learn about our nursery stock, services, and operations, or to contact us.

We may suspend or terminate your access to the Site at any time, without notice, for conduct we reasonably believe violates these Terms.
The Site describes our nursery practices, quality assurance program, varieties, rootstock, and general horticultural information. This content is provided for general informational purposes only.
Site content is not:
Growing conditions, climate, soil, water, disease pressure, rootstock and scion selection, planting practices, irrigation, nutrition, canopy management, and pest and disease control vary enormously between sites and are outside our control. Descriptions of variety characteristics, vigor, yield, timing, fruit appearance, or performance are general and do not predict results in your vineyard.
Nothing on the Site creates a warranty of any kind. All warranties, terms, and conditions relating to nursery stock we sell are set out exclusively in the written purchase agreement, order confirmation, sales contract, or invoice between you and Casa Cristal. Where the Site conflicts with those documents, those documents control.
Information on the Site about varieties, rootstock, availability, or pricing is an invitation to inquire, not an offer capable of acceptance. No contract for the sale of plant material is formed through the Site. Orders are subject to our written acceptance, availability, and separate terms of sale.
The Site may reference programs, certifications, testing protocols, or standards, including those associated with the California Department of Food and Agriculture, Foundation Plant Services, the National Clean Plant Network, and similar bodies. These references describe our participation and practices as of the date posted. They are not endorsements of Casa Cristal by those organizations, and they do not guarantee any particular regulatory or phytosanitary outcome. Requirements change; verify current requirements with the relevant agency.
Read this section carefully if you are relying on any image on the Site.
The Site contains photographs, illustrations, renderings, and video of vines, rootstock, grafts, fruit, foliage, root systems, nursery operations, and vineyards (“Images”).
Images are illustrative only. They depict particular plants, at a particular stage of growth, at a particular time, under particular growing conditions, at a particular location. They are provided to give a general impression of our operations and product types.
Images are not samples or models. No Image is offered or intended as a sample, model, specimen, or exemplar of the goods we supply, and no Image is or becomes part of the basis of any bargain between you and Casa Cristal. No Image creates any express warranty that plant material we deliver will conform to that Image in appearance, size, caliper, root mass, graft union, color, vigor, fruit characteristics, or any other respect.
Images may be edited. Images may have been cropped, resized, retouched, color-corrected, white-balanced, sharpened, composited, digitally enhanced, professionally lit, staged, or otherwise processed for clarity, presentation, or aesthetic purposes. Some Images may be stock photography, archival material, or images not depicting Casa Cristal stock. We make no representation or warranty that any Image is unmodified, unaltered, unedited, or an accurate representation of any plant material we will supply to you.
Color and display vary. Color, tone, and detail as displayed depend on your screen, device, browser, and settings, and will not accurately reproduce the appearance of living plant material.
Mature plants and fruit. Images showing established vines, canopies, clusters, or harvested fruit depict plants years after nursery delivery, grown under site conditions, cultural practices, and management entirely outside our control. Such Images are not a prediction, projection, guarantee, or representation of the yield, quality, appearance, timing, uniformity, survival, or commercial performance you will achieve. Results vary and depend on factors we do not control.
No reliance. You agree not to rely on any Image in deciding whether to purchase plant material, and you agree that no Image forms any part of the description of goods under any sales contract with us. If the appearance or specification of plant material matters to your purchase, request written specifications or inspect the stock before accepting delivery.
The Site and its content — text, graphics, photographs, logos, layout, and design — are owned by Casa Cristal or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your own informational and business purposes. You may print or download individual pages for internal reference. All other rights are reserved.
“Casa Cristal” and our logos are our trademarks. You may not use them without our prior written consent.
Information you submit through Site forms is handled as described in our Privacy Policy. Do not submit confidential or proprietary information through the Site. Any suggestions, ideas, or feedback you send us may be used by us without restriction or compensation.
The Site may link to third-party websites. We provide these links for convenience only. We do not control, endorse, or assume responsibility for the content, accuracy, or practices of any linked site. Access them at your own risk.
THE SITE AND ITS CONTENT, INCLUDING ALL IMAGES, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranty arising from course of dealing, course of performance, usage of trade, or from any sample or model.
We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site or its servers are free of harmful components. We do not warrant the accuracy, completeness, or currency of Site content.
TO THE FULLEST EXTENT PERMITTED BY LAW, CASA CRISTAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CROPS, LOST YIELD, CROP FAILURE, REPLANTING COSTS, DELAYED PRODUCTION, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR YOUR RELIANCE ON ANY SITE CONTENT OR IMAGE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
This section limits liability arising from use of the Site. It does not limit or modify any liability arising under a separate written sales contract for nursery stock, which is governed by that contract’s own terms.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless Casa Cristal and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any action arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Kern County, California, and you consent to the personal jurisdiction of those courts.
We may revise these Terms at any time by posting an updated version on the Site. Changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance. Review these Terms periodically.
We aim to keep the Site accessible to all visitors. If you encounter difficulty accessing any part of the Site, contact us at info@casacristal.com or (661) 792-6468 and we will work to provide the information you need in an alternative format.
Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force.
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Casa Cristal regarding your use of the Site. They do not supersede any separate written agreement governing the purchase of nursery stock, which controls in the event of conflict.
No waiver. Our failure to enforce any provision is not a waiver of that provision.
Assignment. You may not assign or transfer these Terms. We may assign them without restriction in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. These Terms create no rights in any person other than you and Casa Cristal.
Survival. Sections 2, 5, 6, 9, 10, 11, 12, and 15 survive any termination of your access to the Site.
